1 Payment

1.1 Accepted forms of payment by us are all major credit/debit card and paypal payments.

1.2 Goods remain the property of SPX Ltd until paid for in full.

1.3 Payment is required in full (including carriage if necessary) at the time of placing the order.

 

2 Pricing

2.1 Prices displayed on this site are correct at the time of display. We reserve the right to alter prices from time to time without notice. However, once we have accepted your order, we will not change the price that applies to such order.

2.2 Every effort is made to maintain prices, but prices may occasionally move up or down depending upon changes in raw material or other processing costs.

2.3. All prices displayed are inclusive of United Kingdom VAT at the prevailing standard rate.

3 Representations of Products Displayed

3.1 Guarantees cannot be made that the colour of the products shown will look like the actual product that you receive.

3.2 We have attempted to display all the goods on the site as accurately and fairly as possible, taking account of the available reproduction techniques that apply to website design, graphical and photographic technology. Some differences in the products may happen

3.3 A description of the goods is set out on our website. Whilst we will attempt to ensure that there are no changes to the goods to be supplied, it is possible that there may be some minor variations to the description and/or specification of the goods that arise by virtue of changes made by the manufacturers of the parts supplied which form part of the goods.

 

4 Availability of goods

4.1 All products are subject to availability. If an item that you wish to order is unavailable, you will be informed via email or phone. The reason for unavailability is usually because we are awaiting deliveries from our suppliers.

4.2 We shall not charge you for goods that cannot be supplied for any reason.

 

5 Delivery

5.1 Spectacles can only be supplied to UK residents and delivered to a UK address.

5.2 Postage and packaging is £3.50 in the UK, however this may be subject to change without notice.

5.3 Any other service you request may be charged differently.

5.4 Any delivery date given or implied is an estimate only. We do not guarantee to deliver by a specific date but if we have not delivered the product within 30 days of the date on which you ordered them, we shall have no liability to you unless you notify us by email or phone of the problem within 35 days of the date on which you ordered the goods.

If you notify a problem to us under this condition, our only obligation will be, at your option:

5.4.1 to make good any shortage or non-delivery;

5.4.2 to replace or repair any goods that are damaged or defective; or

5.4.3 to refund to you the amount paid by you for the goods in question in whatever way we choose.

5.5 It is your responsibility to ensure that goods can be physically delivered to the address supplied.

5.6 You agree to inspect the goods upon delivery and to notify us within 48 hours by sending an email to returns@designerspx.co.uk should they be in any way defective or inconsistent with your order. In any such event you must not use the product.

5.7 When you have received the goods at the address specified in your delivery instructions, the risk of damage to the goods shall pass to you.

5.8 Should it be necessary to return the goods you are liable for their safe-keeping until such time as they are delivered to us including any period in transit.

5.9 If for any reason (not due to our fault) you do not accept delivery of any of the goods then we may charge you an additional fee to cover any reasonable additional direct costs consequently incurred by us (including additional insurance, delivery, storage or similar charges).

5.10 We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

 

6 Guarantee

6.1 All spectacles carry a 12 month guarantee against faulty materials and defective workmanship. To claim under this guarantee you must obtain a returns number by sending an email to returns@designerspx.co.uk. Refunds will not be made for return postage.

6.2 We reserve the right to repair or replace faulty goods at our discretion.

6.3 Guarantees will not apply where goods have been subject to misuse, have not been used for the intended purpose or have not been used or cared for in accordance with any specific instructions issued with the product.

6.4 Refunds will not be made if incorrect prescription information has been entered by the customer at the time of order.

6.5 The risk of damage to any goods you return to us will remain with you until the goods have been delivered to our premises and accepted at the premises.

 

7 Cancellation, Changes and returns

7.1 Since prescription spectacles are made to your personal specification, orders of this nature cancelled before dispatch may incur a charge for time and materials used in preparation of the order.

7.2 Changes to your prescription spectacle order made before dispatch may incur an additional charge for time and materials used in preparation of the order.

7.3 If the product supplied is suspected not to match the prescription ordered, do not use. Please notify us within 48 hours via email or phone. In the rare event that this might occur, please send your goods back within 7 days so that we can verify the prescription that has been applied to your purchase. If an error on our part has indeed been made in the construction of the customer's lenses, we will rectify the problem and send the corrected product to you. If for any reason, we cannot rectify the problem, we will offer the customer a full refund.

7.4 The product is your responsibility until it reaches us. For your own protection, we recommend that you send the parcel using a delivery service that insures you for the value of the goods.

7.5 The cost of delivery and or insurance is non-refundable

7.6 We expect the prescription spectacles or sunglasses to be returned in the packaging in which they were received, if they are damaged in transit to us it is the responsibility of the customer to claim back all costs from the company with which the product were returned. We reserve the right to return faulty glasses back to customers that have been damaged in transit. The product must also be returned with/in any branded material that they are received in, e.g. cases, boxes and with the warranty card and cloth (if applicable).

7.7 If you are unhappy with the sunglasses ordered than notify us within 48 hours via email or phone. In this unfortunate circumstance please send the goods back within 7 days and we will credit your account the amount you paid minus £10 for the handling fee.   You do not need to give us any reason for cancelling your contract.

 

8 Cancellation by us

8.1 We reserve the right to cancel the contract between us if:

8.1.1 we have insufficient stock to deliver the goods you have ordered;

8.1.2 we do not deliver to your area;

8.1.3 one or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers; or

8.1.4 you have previously made a claim for non-delivery of goods

8.2 We reserve the right to refuse your Order if the delivery address is outside the United Kingdom, if it is for single-vision spectacle lenses with a spherical value of more than +/-8 dioptres or a cylindrical value of more than +/-4 dioptres. We will refuse your Order, too, if it is for bifocal or varifocal lenses as this is deemed to be more complex in nature and more measurements would be needed which is not possible to make them up accurately without seeing being face to face.

 

9 Liability

9.1 We will not be liable for any visual problems, loss of any nature, accident or injury, as a result of incorrect information supplied by you or the original prescriber.

9.2 We do not accept liability for any consequential or incidental damages as a result of products purchased from or use of this website and our liability for direct loss is limited to the purchase price of the product from which any such claim shall arise.

9.3 We shall not be liable for any allergic reaction to frame or lens materials. All frame materials are indicated and the purchaser accepts full responsibility for choosing a frame based on this information. Frames described as 'Metal' may contain nickel alloys. Unless stated otherwise, frames are not supplied as 'hypo-allergenic'.

9.4 You accept responsibility for entering your prescription details and providing a 'PD' measurement.

9.5 Unless you state otherwise, we use an appropriate average pupillary distance 'PD' to complete your order. This PD measurement has been provided by qualified ophthalmic and dispensing opticians. By agreeing to these terms and conditions, and unless you state otherwise, you will be agreeing to let us use an average PD of 63mm for single vision distance lenses, or a PD of 60mm for single vision reading lenses. We recommend that you consult your optician to obtain your PD before ordering, and provide that number to us when ordering.

9.6 You must provide us with details of any problems you have experienced when wearing glasses in the past in the comments box.

 

10 General

10.1 By placing an order you agree to receive e-mails from us regarding special offers and other information relevant to your purchase. You can choose not to receive e-mails from us at any time by notifying us at returns@designerspx.co.uk or following the instructions in any e-mail we have sent.

10.2 No employee or agent of SPX Ltd has the right to vary these terms and conditions.

10.3 These terms and conditions shall be governed by English Law.

10.4 You confirm that you are aged over 18 years old and are legally able to purchase prescription spectacles or sunglasses from us.

10.5 You confirm that you are not registered blind or partially sighted

10.6 We can only supply lenses to a valid prescription that is less than two years old (, or less than one year old if you are over 70 years of age). We reserve the right to ask for a copy of that prescription.

10.7 You must provide us with prescriptions given to you by a registered medical practitioner or registered Ophthalmic Optician following a testing of sight by him or her within the last two years (or one year if you are over the age of 70).

10.8 A binding contract is only entered into when we accept your order.

10.9 These terms and conditions are subject to change at any time without prior notice to you.

10.10 Nothing in these terms and conditions shall affect your statutory rights
